3. Presentation of the services offered via the YallaXash application

This is an application that allows online money transfer transactions.

To be able to carry out a transfer operation by the YallaXash application, the user must identify himself by creating and using his personal account (Existing and owned phone number that can be verified. Existing and owned email address that can be verified. Use his real First name, Last name, Birth date, that can be verified with a Canadian Identification (ex: an ID)) and through a login and a password, which allows him to perform and track his remittance operation to a third party.

4. Eligibility - Registration - Acceptance of Terms and Conditions

To be eligible to register and use the services offered by YallaXash, you must be at least 18 years old and have the legal capacity to enter a contractual relationship.

As a person, you testify and warrant to YallaXash that you have the required minimum age, the legal capacity to enter into a contract and that you use the services offered by YallaXash only in your own name.

To confirm your registration and before you can use its services, YallaXash reserves the right to verify your identity and ask for your collaboration to do so.

YallaXash can perform a verification of your credentials and reserves the right to query for this purpose various national authorities and private databases to confirm or deny the information provided by you. Any suspicious identity or activity may be reported to appropriate and competent authorities, including the Canadian authorities responsible for preventing fraud and combating money laundering.

This verification procedure is in accordance with Canadian regulations.

YallaXash reserves the right to reject any new registration or transfer requests, and to block a suspicious transaction or account, if certain elements provided by you seem to be incorrects, falsified, or in contradiction with the regulations (fraud, money laundering, criminal activity …)

Your login and password are strictly confidential and personal.

In the event of disclosure from you, YallaXash can not be held responsible.

5. Privacy Policy - Privacy – Respect for Privacy

To enable your registration as a user of YallaXash services via its application, you have provided personal data about you.

Those data are processed electronically and communicated to the appropriate authorities to verify your identity, as well as to the regulatory authorities to which YallaXash is submitted in Canada.

To process your request for transfer of funds, you have communicated personal data to YallaXash concerning you and the recipient of the payment requested by you.

Those data are processed automatically and electronically. They will be transferred to the country of destination of your transfer and the supervisory authorities on which YallaXash depends may have access to information extracted from your request for transfer of funds. And possibly obtain a copy of the confirmation and follow-up messages transmitted electronically.

6. Terms of the services offered for online transfers

By using your personal user account, you will be informed on real-time of discounted exchange rates and commission amounts, which will be applied by simulating the money transfer amount displayed on your app.

The displayed exchange rate for a transaction is only valid for the time of that specific transaction. The exchange rate can change according to the international exchange rate.

Our application allows you to consult the history of your transfers, and also to follow your current transfers in real time.

The creation of your personal user account is mandatory for any transfer of funds. Personal information about the recipient of your funds (identification, address, phone number, email address, bank details if necessary, etc.) will be required.

You must indicate the amount of the transaction in order to know the amount of the commission, (the commision may vary depending on the amount of that transaction). The amounts transferred are paid in Canada, in Canadian dollars, or are converted into US dollars or local currency, depending on the country of destination.

7. Limits - Restrictions or Suspensions - Blocking a Transfer - Third Party Acts

The maximum amounts that can be transferred are as follows:

For unverified clients :

  • The maximum unit amount allowed for a transfer of funds is CAD 999;

  • The maximum cumulative total of transactions per 24-hours period is CAD 999;

  • The maximum cumulative amount allowed per 30-days period is CAD 5,000;

  • The maximum cumulative amount allowed per 90-days period is CAD 8,000;

  • The annual limit for accumulated transfers is fixed at 20,000 CAD. For verified clients :

  • The maximum unit amount allowed for a transfer of funds is CAD 5000;

  • The maximum cumulative total of transactions per 24-hour period is CAD 5000;

  • The maximum cumulative amount allowed per 30-day period is CAD 15,000;

  • The maximum cumulative amount allowed per 90 day period is CAD 40,000;

  • The annual limit for accumulated transfers is limited at CAD 100,000.

  • Exceeding these limits allows YallaXash to reject or defer your transactions.

Similarly, any repeated transfer of funds to the same recipient may be the subject of either a rejection or a request for additional information from the sender.

YallaXash disclaims any liability for consequences resulting directly or indirectly from the actions of users.

8. Fees for commissions charged

The amount of money retrieved by the recipient is considered net of commission.

The commission charged by YallaXash can change based on the amount sent and the exchange rate applied. Rates are shown to the user before and during any transaction.

9. Right of retractation (cancellation of a transfer request)

A transaction cancellation is possible as long as the transaction is not withdrawn.

In this case, the user will be reimbursed of the amount of the transaction excluding commissions.

Your account will be credited with the reimbursed amount directly on the YallaXash app.

10. Deadlines

YallaXash agrees to deliver the funds sent to the recipient within 48 hours, under the following conditions:

  • All information provided by the sender is accurate, complete and validated by YallaXash services.
  • The recipient has the legal capacity to collect and withdraw funds
  • YallaXash Services are not exposed to force majeure.
